Several months ago, Eater reported on a conflict between Tangerine nightclub owner Darnell Small and Rivertown Holdings, a company owned by Atwater's Mark Reith. The club owner has fought several attempts by Rivertown to evict him. Rivertown contends Small damaged the property, does not hold proper permits, and failed to pay his rent on time. Small denies these claims and believes Reith is trying to bully him into breaking the rental agreement. Small lost his court battle in January and has not been granted a repeal.

Representatives for Small tell Eater that Rivertown filed an emergency application to evict Small from the property yesterday. If the motion was granted, Small would be forced to leave. The parties were due in court today where a final decision was expected. However, Metro Times reports the judge postponed the final decision until May 11.

Small's attorney Jan Rubenstein tells the weekly, "We're probably going to get this settled in the interim," but that a settlement would still likely require Small to vacate.
